Bankruptcy is a way the law helps people or businesses deal with debt collection. Debt collection is not new to modern times. It dates way back to the B.C. era. This is because people had debts even in the simplest agragrian societies and like in modern times, these people found themselves in a position where they could not pay their debts due to an unforeseen income loss or an unexpected event. Did you know that the Old Testament discusses a jubilee year occurring every fifty years where you would be released from paying your debts in that year? Yes, a discharge of your debts - that is something to celebrate! The more sophisticated the economy became, the more necessary debt relief became.  Bankruptcy laws are federal laws embodied in Title 11 of the United States Code. A federal bankruptcy judge presides over bankruptcy cases.  An individual or business who files for bankruptcy protection is seeking to recover from a financial setback. In a chapter 7 bankruptcy, the debtor is seeking to discharge debts while retaining exempt assets. In a chapter 13 or a chapter 11, the debtor is seeking to restructure debts under a plan and to rehabilitate. The goal of a bankruptcy is to offer an honest debtor a discharge of debts to enable a fresh, new start.  A debtor is the person or business filing for bankruptcy. While there are many protections available to the debtor in bankruptcy, the Bankruptcy Code offers safeguards to creditors or those who are owed a debt. In sum, bankruptcy is not a new novel idea. It has been around for a really long time and for centuries people have been seeking bankruptcy relief.

Seasoned Bankruptcy Attorney

Kimberly Berson knows bankruptcy. She has been practicing in the field her entire career and has experience representing all the varied interests in a bankruptcy proceeding. During law school, Kim was a summer intern for a bankruptcy judge. Her first position after she graduated law school was with a chapter 7 trustee. Kim also worked in the bankruptcy department at one of the largest law firms on Long Island where she represented finanacial institutions in bankruptcy proceedings, chapter 7 trustees, individual chapter 7 and 13 debtors and business chapter 11 debtors. She spent most of her career working at a boutique bankruptcy law firm where she was involved in bankruptcy litigation, chapter 11 business reorganizations and individual consumer cases. For the past three years, Kim has been a member of the academic community. She teaches future paralegals bankruptcy law, legal research and writing and contract law. She has also served as an adjunct professor for the business school at Hofstra University teaching legal studies courses. Kim provides consultation services to other bankruptcy firms while representing her own clients. Kim firmly believes that it is so important to hire experienced bankruptcy counsel if you are seeking debt relief. It makes all the difference how the case progresses. 

Kim attended Binghamton University where she earned a B.A. in Political Science and earned a Juris Doctorate at Touro Law Center. She was a member of moot court while in law school.
